Dear Customer,
We contact you regarding our supplies of liquid oxygen (hereinafter also "product") and in accordance with the contract concluded between us and applicable laws, we hereby notify you the existence of the force majeure event described below, that exists without our fault and prevent us to supply you with our product in the required volumes.
Due to the current peak of the COVID-19 pandemic and related government measures, we have been forced to prioritize the supply of oxygen and other gases to healthcare facilities (esp. hospitals), moreover the volume and frequency of oxygen supplies to healthcare facilities have increased several times and adversely affect our transport capacity of our products.
Unfortunately, several adverse factors occurred at the same time, in particular:
- a significant and unpredictable increase in liquid oxygen consumption,
- a priority to supply oxygen to medical facilities (patients with COVID-19),
- a growing number of infected or quarantined drivers,
- a growing number of infected or quarantined employees of Linde,
- longer transport distances and more complex logistics of product deliveries with regard to the utilization of production resources,
- complications when crossing borders,
- complications associated with emergency measures taken by government bodies.
However, we would like to assure you that we are working hard to manage the situation and we are taking all steps to maintain the supply of liquid oxygen as well as other products in the largest possible volumes.
In order to ensure that your orders for products are met, we need to improve our cooperation and effective communication. In particular, it is necessary on your part to:
- continuously check the liquid oxygen tanks to ensure that they are in order and fully functional,
- order liquid oxygen well in advance, esp. if you do not have telemetry units installed on the tanks connected with automatic loading of products,
- inform us well in advance of the expected increase in product consumption.
